Custody and Child Support Modification and Enforcement Actions

If your divorce is final, but your circumstances have changed, you may be able to modify the terms of your divorce judgment, from child custody and visitation arrangements to support payments. If your ex is not in compliance with the terms of your divorce decree, you can file a motion for contempt, using the enforcement power of the court to protect your interests.

My Custody and Child Support Modification Practice

I will represent either side in proceedings to modify the terms of an existing divorce judgment, whether you seek modification of custody, visitation or support. I will help you work toward new agreements that are in the best interests of your minor children, but that take your needs as parents into consideration as well.

If you have lost a job, experienced a shift change or been promoted to a new position with different responsibilities, it can change your ability to provide support or be available for custody or visitation. I also handle situation where children's needs change or they reach the age of 14 and want more input into where they live and how custody and visitation take place.

Protecting Your Rights in a Contempt Proceeding

I will represent either party in a contempt action, helping you with enforcement of the court's custody or child support order or challenging assertions that you are failing to meet your obligations. I will handle all matters, preparing and filing all necessary documents, including affidavits or statements to the judge.

When appropriate, I will file an ex parte order, getting the judge to immediately sign an order requiring your ex to show cause why he or she should not be held in contempt. The court will simultaneously set a date for a hearing to determine whether your ex is in violation of the terms of your divorce.

Once the motion is signed, your ex can either admit the failure to comply and make arrangements to remedy the situation, or the court will set a trial date. With extensive experience in family law litigation, I will assertively protect your interests in court.
